Driveway drainage: culverts, swales, aprons, and where the water is supposed to go
Every driveway problem on this site ends at the same question: where does the water go? A driveway that washes out, floods a garage, or eats stone is a driveway carrying water that should have been intercepted somewhere else. This page is about the somewhere else.
The culvert and apron at the end of your driveway sit in the road authority’s right of way, so the road decides the permit: a town road means the town’s ordinance, a county road means the county engineering office, and a state highway means an NJDOT access permit under N.J.A.C. 16:47. And under New Jersey’s reasonable use rule, collected driveway runoff cannot simply be aimed at the neighbor.
The four tools, and which problem each one solves

The order matters. Shape first, interception second, hardware last. A trench drain bought to compensate for a missing crown is treating the symptom at ten times the price. What a gravel drive costs to build properly in the first place is on gravel driveways.
Who permits the culvert under your driveway
This is the part nobody explains until an inspector does. The end of your driveway, the apron and the culvert are in a road right of way, and the authority that owns the road decides what goes in it. Which authority that is depends on the road, not the town you live in.

Notice what the Vernon ordinance actually regulates: not the look of the driveway, the water. That is what all of these permits are protecting. Your culvert is a working part of the road’s drainage system, and the road authority wants it sized and set so their road does not flood at your frontage.
You cannot just aim the water at the neighbor
Every drainage fix ends with the same question: where does the water go instead? The tempting answer, downhill onto somebody else, has seventy years of New Jersey law attached to it. In Armstrong v. Francis Corp. (1956) the state Supreme Court adopted the reasonable use rule for surface water: altering how water leaves your land is allowed, even where it causes some harm, but you are liable when the interference is unreasonable, and the court weighs the benefit to you against the damage to them.
In practice: sheet flow that has always run downhill is one thing. Collecting a driveway’s worth of runoff into a single pipe and discharging it at the property line is another, and it is the version that ends up in front of a judge. This is why we walk the water path before quoting, and why the outlet, not the pipe, is the real design problem on most of these jobs.
The culvert is part of the road's drainage, not just yours
The ditch along the road is doing a job: it drains the road. Your driveway crosses it, and the culvert under your driveway is the only thing keeping that system flowing. That is why the road authority cares what size it is and how it is set, and why a crushed or silted driveway culvert is worth fixing before it announces itself. When one chokes, water backs up along the ditch, saturates the base of your driveway from underneath, and takes the edge of the road with it. We replace culverts that failed years before anyone noticed, because the failure happened underground and the washout happened later.
Freeze and thaw plays its part here too. A culvert holding standing water because its outlet silted in becomes an ice plug in January, and ice does to a pipe what it does to everything else in this ground: moves it, cracks it, and leaves the joint open for the spring melt to exploit.
Disturbing more than 5,000 square feet?
Reshaping swales and regrading along a long drive adds up. Questions people ask
Why does water run down my driveway into the garage?
Because the driveway slopes at the garage and nothing intercepts the water before it gets there. The driveway is doing exactly what its shape tells it to do. The fix is to catch the water partway down with a trench drain or a cross swale and give it somewhere lower to go, or, where there is room, to regrade so the last stretch pitches away from the door. A grate at the garage lip is the last line of defence, not the plan: by the time water reaches it, it is carrying silt that will clog whatever it falls into.
What size pipe does a driveway culvert need?
Whatever the ditch it interrupts actually carries in a storm, which is why the town or county has a say. Fifteen inches is a common minimum around here, but the honest answer is that the road authority usually sets it, either in an ordinance or on the permit, because an undersized culvert backs water onto their road. Guessing small is the expensive mistake: a culvert that chokes in a storm washes out your driveway from underneath and floods the roadside both ways.
Do I need a permit for a driveway culvert in New Jersey?
Usually, and who issues it depends on whose road your driveway meets, not on your address. On a municipally accepted road, the town's own ordinance typically governs: Vernon Township, for example, has required a permit before constructing any driveway onto a Township road since 1970, and its ordinance says outright that a driveway shall be constructed to prevent water from draining across the Township street. On a county road, work in the county right of way needs a permit from the county: in Sussex County that is a Road Opening and Access Permit from the Division of Engineering. On a state highway, access is permitted by NJDOT. The common thread is that the culvert and the apron sit in the road authority's right of way, so the road authority sets the terms.
Can I just pipe my driveway runoff onto the neighbor's property?
Not at will, and the rule is more interesting than a flat ban. New Jersey follows the reasonable use doctrine for surface water, set by the state Supreme Court in Armstrong v. Francis Corp. in 1956: you may alter how surface water flows off your land, even where it causes some harm, but you are liable when the interference is unreasonable, weighed by how much good it does you against how much harm it does them. Concentrating your whole driveway's runoff into a pipe aimed at the neighbor's yard is the classic way to lose that argument. The practical answer is to give the water a legal outlet on your own terms: daylight on your own low ground, a dry well sized for the volume, or the roadside ditch where the road authority allows it.
Can I tie my driveway drain into the sewer?
No. N.J.A.C. 7:14A-23.6 requires sewer systems to be designed so that water from roofs, cellars, streets and other areas is excluded, and driveway runoff is exactly that water. Stormwater in a sanitary sewer is called inflow, and enough of it overwhelms the treatment plant, which is the whole reason the rule exists. A driveway drain needs its own outlet: daylight at a lower elevation, a dry well sized for the volume, or a permitted connection to a storm system, which is a different pipe than the sewer.
How much does driveway drainage work cost?
It depends on what the water needs, and the spread between the options is the useful information. A swale cut alongside a drive is machine time and shaping. A culvert is pipe, stone, and the excavation to set it at the right grade, plus whatever the road authority requires at the ends. A trench drain across a paved apron involves cutting, the drain itself, and somewhere for it to discharge. The pattern in all three: the pipe or the drain is rarely the expensive part, the digging and the outlet are. We price it after walking the water path, because a drainage quote that has not found the outlet is not a real quote.
Will a French drain fix my driveway drainage?
Only if the problem is groundwater, and driveway problems usually are not. A French drain collects water that is IN the ground. Water sheeting down a driveway surface never enters it, and it silts a French drain shut if it does. Surface water wants surface solutions: crown, swale, cross drain, culvert. Where a French drain does earn its keep is a driveway cut into a slope that weeps from the uphill side, and even then it needs its own legal outlet, never the sewer.
